Quebec's Law 25, fully enforceable since September 2024, is materially more prescriptive than federal PIPEDA — requiring Privacy Impact Assessments, privacy-by-design principles, mandatory DPO appointment for certain organisations, and data localisation accountability for cross-border transfers under Section 17. We architect dual-compliance infrastructure by partitioning data flows at the API boundary: Quebec user data is processed under Law 25-compliant architecture, federal operations run under PIPEDA-aligned systems, and US-market integrations operate through isolated service layers. Each regime is satisfied structurally, not managed through overlapping policy documentation.
CASL requires express or implied consent for commercial electronic messages, sender identification in every message, and a functioning unsubscribe mechanism honoured within ten business days. Penalties reach CAD 1 million for individuals and CAD 25 million for organisations per violation.
